Introduction
These Terms and Conditions govern the use of the website, services, training programmes, short courses, online courses, customised training, registrations, payments, course material , and related services offered by Risk and Investigation Training Academy (RITA). By accessing this website, submitting an enquiry, completing a registration form, making payment, attending a course, downloading course material or using any of our services, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not use this website, register for a course or make use of RITA’s services.
Definitions
For purposes of these Terms and Conditions:
- “RITA”, “we”, “us” or “our” refers to Risk and Investigation Training Academy (RITA). “Client”, “delegate”, “you” or “your” refers to any person, company, organisation, institution or representative who accesses the website, submits an enquiry, registers for a course, makes payment or attends any training presented by RITA.
- “Course” means any short course, virtual course, online training, in-house training,
customised training, workshop, webinar, seminar or learning intervention presented by
RITA.
- “Delegate” means the individual attending the course.
- “Registration” means the process of enrolling a delegate for a course.
- “Course material” means any notes, slides, documents, manuals, templates, recordings,
presentations or resources provided by RITA before, during or after a course.
Services Offered
RITA provides professional training services in fraud prevention, forensic investigations,
workplace investigations, ethics, compliance, risk management and related fields.
Our services may include, but are not limited to:
- Standard short courses
- Virtual and online training
- In-person training
- In-house training
- Customised training programmes
- Workshops and seminars
- Professional development training
- Course material and learning resources
- Certificates of attendance where applicable
RITA reserves the right to amend, update, replace, postpone, cancel or withdraw any course, course date, course content, presenter, price or training format at its discretion.
Website Use
You may use this website for lawful purposes only. You may not:
- Use the website in a manner that is unlawful, fraudulent, harmful, misleading or abusive
- Attempt to interfere with the website’s operation or security
- Copy, reproduce or distribute website content without permission
- Upload or transmit harmful code, malware, spam or unauthorised material
- Misrepresent your identity or submit false information
- Use RITA’s name, logo, course material or intellectual property without written permission
RITA reserves the right to restrict or terminate access to the website or services where misuse is suspected.
Course Information
RITA aims to ensure that all course information published on the website, social media, emails, brochures and registration forms is accurate and up to date. However, errors may occur.
Course dates, prices, availability, course outlines, presenters, delivery methods and related information may change without prior notice.
A course is only confirmed once RITA has issued confirmation of registration and the required payment has been received, unless otherwise agreed in writing.
Registration
To register for a course, the client or delegate must complete the required registration form and provide all information requested by RITA.
The client is responsible for ensuring that all information submitted is accurate and complete, including delegate details, billing details, contact information and course selection.
Submission of a registration form does not automatically guarantee a seat. Seats are limited and registration is only confirmed once payment has been received, unless otherwise agreed in writing by RITA.
RITA may refuse, cancel or delay a registration where:
- Required information is missing
- Payment has not been received
- The course is fully booked
- The client has outstanding amounts owing to RITA
- The information provided is false, incomplete or misleading
- The delegate does not meet course requirements, where applicable
- There is any other valid operational, legal or business reason
Payment Terms
All course fees must be paid in full before the course commences, unless RITA has agreed otherwise in writing.
Where a quotation or invoice is issued, payment must be made according to the invoice terms.
RITA reserves the right to deny access to any course where payment has not been received before the course starts.
All prices are quoted in South African Rand unless otherwise stated. Prices are exclusive of VAT unless expressly stated otherwise.
Bank charges, foreign transaction fees, currency conversion costs and any other payment. Related charges are for the client’s account.
Proof of payment must be sent to RITA when requested.
Promotional Pricing and Discounts
RITA may from time to time offer promotional prices, discounts or special offers. Promotional prices are valid only for the period stated and may be withdrawn or changed at any time.
Discounts may not be combined unless RITA confirms this in writing. A promotional price does not apply retrospectively to registrations or payments already completed before the promotion was announced, unless RITA agrees otherwise in writing.
Cancellations by the Client
All cancellation requests must be submitted to RITA in writing by email.
The following cancellation terms apply unless otherwise stated in writing:
- Cancellations received 14 calendar days or more before the course start date may qualify for a refund, subject to a reasonable administration fee and any costs already incurred by RITA.
- Cancellations received less than 14 calendar days before the course start date may result in the client forfeiting 50% of the course fee.
- Cancellations received 7 calendar days or less before the course start date may result in the full course fee being payable and no refund being due.
- No refund will be granted where a delegate fails to attend, arrives late, leaves early, does not participate, experiences personal scheduling conflicts, or does not notify RITA of cancellation in writing before the course starts.
- Where a course has already commenced, no refund will be granted. RITA may, at its discretion, allow the client to transfer the registration to a future course date or substitute the delegate with another person, subject to availability and operational requirements.
Refund Policy
Refunds are not automatic and must be requested in writing. Refund requests will be assessed according to:
- The date of cancellation
- The course start date
- The amount already paid
- Costs already incurred by RITA
- Whether course material or access links have already been issued
- Whether the course has already commenced
- Whether the delegate attended any part of the course
- Any applicable legal requirements
Approved refunds will be processed within a reasonable period after approval, generally within 30 days, unless delays occur due to banking processes, verification requirements or administrative factors outside RITA’s control.
Refunds will be made to the original payer or nominated account approved by RITA.
RITA may deduct reasonable administration fees, bank charges, transaction fees, material costs and other costs already incurred.
No refund will be granted for downloaded, accessed or issued course material, unless required by law or approved by RITA in writing.
Cooling-Off Period
Where the Consumer Protection Act or any other applicable South African law provides a statutory cooling-off right, RITA will comply with such legal requirements. Where a registration arises from direct marketing and the law provides a cooling-off period, the client may be entitled to cancel within the prescribed period by giving written notice to RITA.
The cooling-off right may not apply in all cases, including where the service has already commenced with the client’s consent or where the course date is too close to the registration date.
Cancellations or Postponements by RITA
RITA reserves the right to cancel, postpone, reschedule or change a course due to unforeseen circumstances, insufficient registrations, presenter availability, technical issues, illness, operational requirements, force majeure events or any other reasonable cause.
If RITA cancels a course and no alternative date is offered, the client may elect to receive a refund of the amount paid for that course. If RITA postpones or reschedules a course, the client may elect to attend the new date or
request that the payment be credited towards another RITA course.
RITA will not be liable for any indirect losses, travel costs, accommodation costs, loss of income, loss of business, loss of opportunity or any other costs incurred by the client or delegate as a result of cancellation, postponement or rescheduling.
Delegate Substitutions
A client may request to substitute a registered delegate with another delegate.
Substitution requests must be submitted in writing before the course starts.
RITA may approve substitutions at its discretion, provided that the substitute delegate’s details are provided in time and the substitution does not affect course administration, certificates or course requirements.
Transfers to Future Courses
RITA may allow a delegate to transfer to a future course date where a written request is made before the course starts.
Transfers are subject to availability and approval by RITA.
Only one transfer may be allowed unless RITA agrees otherwise in writing.
If the future course fee is higher, the client may be required to pay the difference.
If the delegate fails to attend the transferred course, the fee may be forfeited.
Online and Virtual Training
Most RITA short courses may be presented online via platforms such as Zoom, Microsoft Teams or another suitable virtual platform.
Delegates are responsible for ensuring that they have:
- A stable internet connection
- A suitable device
- Working audio and microphone where required
- Access to the correct platform
- A quiet and suitable learning environment
- The ability to access links, emails and course material
RITA is not responsible for a delegate’s internet failure, device failure, load shedding, firewall restrictions, employer restrictions, incorrect email address, late login or failure to access the platform.
Delegates are encouraged to test their access before the course starts. Where possible, RITA may provide reasonable technical guidance, but RITA is not responsible for resolving a delegate’s personal or organisational IT issues.
Course Attendance
Delegates are expected to attend the full course, participate professionally and comply with the presenter’s instructions.
RITA reserves the right to remove or refuse access to any delegate who is disruptive, abusive, dishonest, unethical, intoxicated, threatening, harassing others, sharing unauthorised content or otherwise acting in a manner that affects the learning environment.
No refund will be granted where a delegate is removed from a course due to misconduct.
Certificates
A certificate of attendance may be issued after successful attendance of a course, where applicable.
Certificates are issued based on attendance and participation, not formal competence, unless expressly stated otherwise in writing.
RITA may withhold certificates where:
- Payment has not been received
- The delegate did not attend the required portion of the course
- Delegate details are incomplete or incorrect
- There is suspected dishonesty or misconduct
- Administrative requirements have not been met
RITA may charge an administrative fee for certificate re-issues, corrections or replacements where the error was caused by incorrect information supplied by the client or delegate.
Course Material and Intellectual Property
All course material, presentations, manuals, templates, slides, notes, recordings, documents, website content, branding, logos and training resources remain the intellectual property of RITA or its licensors, unless otherwise stated.
Clients and delegates may use course material for personal learning and internal reference
purposes only.
You may not, without RITA’s prior written consent:
- Copy, reproduce or distribute course material
- Sell, resell or commercially exploit course material
- Upload course material to any website, platform, cloud storage or public forum
- Record, photograph, screenshot or reproduce live training sessions
- Use RITA’s material to present your own training
- Remove copyright notices or branding
- Share access links with unauthorised persons
- Create derivative works from RITA’s material
Unauthorised use of RITA’s intellectual property may result in legal action.
Recordings
Delegates may not record, photograph, screenshot, livestream or distribute any part of a RITA course without prior written permission. Where RITA records a session, the recording remains the property of RITA.
RITA is not obligated to provide recordings unless expressly agreed in writing. If recordings are made available, they may be subject to access limits, expiry dates and usage restrictions.
Customised and In-House Training
For customised, corporate or in-house training, the final scope, dates, deliverables, fees and terms will be agreed in writing. A deposit or full payment may be required before development or delivery begins. Where RITA has commenced preparation, customisation, development or scheduling, cancellation fees may apply.
Customised course material developed for a client remains the intellectual property of RITA unless otherwise agreed in writing.
RITA may charge additional fees for:
- Custom content development
- Additional course days
- Travel and accommodation
- Printing
- Venue costs
- Assessment services
- Additional facilitator time
- Repeated sessions
- Changes requested by the client after approval of the course scope
Accreditation and Professional Recognition
Unless expressly stated in writing, RITA short courses are practical professional development courses and do not constitute a formal qualification, licence, certification or professional designation.
Where a course is accredited, recognised for CPD points or aligned to a specific body, this will be clearly stated in the course information.
RITA does not guarantee that a course will qualify a delegate for employment, promotion, professional membership, licensing or certification unless this is expressly stated in writing.
No Legal, Financial or Professional Advice
RITA’s training is provided for educational and professional development purposes. Course content must not be treated as legal advice, financial advice, investigation instruction for a specific case, or a substitute for professional advice from a qualified legal, financial, forensic, HR, compliance, risk or other professional adviser.
Delegates and clients remain responsible for applying the training appropriately in their own workplace and legal environment.
Accuracy of Information
RITA aims to provide accurate, practical and current training content. However, laws, regulations, standards, professional practices and organisational requirements may change.
RITA does not warrant that all course content will remain current after the course date. Clients and delegates should verify legal, regulatory and organisational requirements applicable to their specific circumstances.
Privacy and Personal Information
RITA respects the privacy of clients, delegates and website users. By submitting personal information to RITA, you consent to RITA collecting, processing and storing such information for legitimate business purposes, including:
- Responding to enquiries
- Processing registrations
- Issuing invoices and receipts
- Communicating course information
- Providing training services
- Issuing certificates
- Maintaining attendance records
- Complying with legal and tax obligations
- Marketing RITA’s services where permitted by law
RITA will take reasonable steps to protect personal information and will not sell personal information to unauthorised third parties.
Personal information may be shared with service providers where necessary to provide services, process payments, deliver training, comply with the law or operate the website.
Marketing Communication
By submitting an enquiry, registering for a course or providing your contact details, you may receive communication from RITA relating to courses, services, updates and professional development opportunities.
You may unsubscribe from marketing communication at any time by contacting RITA in writing.
RITA may still send necessary administrative or transactional communication relating to registrations, payments, invoices, course access, certificates or other services requested by you.
Third-Party Links and Platforms
- The RITA website or course communication may include links to third-party websites, payment platforms, video conferencing platforms or external resources. RITA is not responsible for the content, security, accuracy, terms, privacy policies or availability of third-party websites or platforms. Use of third-party platforms is at your own risk and may be subject to separate terms and conditions.
- Payment Platforms and Online Transactions. Where online payments are made available, payments may be processed by third-party payment service providers. RITA does not store complete card details on its website unless expressly stated and securely managed through an authorised payment provider. RITA is not responsible for delays, declined payments, bank errors, payment gateway downtime or third-party payment platform issues.
A registration is only confirmed once RITA has received confirmation of payment. - Limitation of Liability. To the maximum extent permitted by law, RITA will not be liable for any indirect, incidental, special, consequential or economic loss, including loss of income, loss of profit, loss of business, loss of opportunity, loss of data, reputational harm, travel costs, accommodation costs or wasted expenditure. RITA’s total liability for any claim relating to a course or service shall be limited to the amount paid by the client for that specific course or service. Nothing in these Terms and Conditions excludes liability that may not be excluded under applicable law.
- Indemnity. The client and delegate indemnify RITA, its directors, employees, presenters, contractors and representatives against any claim, loss, damage, liability, cost or expense arising
from:
- Incorrect information supplied by the client or delegate
- Misuse of course material
- Unauthorised sharing of access links or materials
- Misapplication of course content
- Breach of these Terms and Conditions
- Unlawful, unethical or negligent conduct by the client or delegate
Force Majeure
RITA will not be liable for failure or delay in performing any obligation where such failure or delay is caused by circumstances beyond its reasonable control. This may include, but is not limited to, acts of God, illness, pandemics, strikes, riots, fire, flood, load shedding, internet failure, power failure, platform failure, government
restrictions, transport disruptions, war, civil unrest or any other event outside RITA’s reasonable control.
In such circumstances, RITA may postpone, reschedule, adapt, move online or cancel the affected course.
Breach
If a client or delegate breaches these Terms and Conditions, RITA may take appropriate action, including:
- Cancelling registration
- Refusing access to a course
- Withholding certificates
- Claiming outstanding amounts
- Recovering damages or losses
- Restricting future registrations
- Taking legal action where necessary
Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms and Conditions, the website, a course, registration, payment or service shall be dealt with in accordance with South African law.
Dispute Resolution
The parties should first attempt to resolve any dispute through good-faith communication. Complaints must be submitted to RITA in writing with sufficient detail to allow RITA to investigate the matter. If the dispute cannot be resolved informally, either party may pursue remedies available under South African law.
Changes to These Terms and Conditions
RITA may update or amend these Terms and Conditions from time to time. The latest version published on the website will apply. Continued use of the website, registration for a course or use of RITA’s services after
changes are published constitutes acceptance of the updated Terms and Conditions.
